Abstract

Bioéthique et Biopolitique. Embryon et régulation. Qui dit " procréation médicalement assistée " aujourd'hui, dit traitement de la stérilité mais aussi développement de biotechnologies conduisant à une médecine régénérative par le recours à des cellules-souches. Une évolution étonnante dont les citoyens et les pouvoirs publics doivent saisir les enjeux politiques, médicaux, économiques, éthiques. Une équipe interdisciplinaire de l'Université catholique de Louvain a mené une recherche de deux ans conduisant à un état des lieux de la procréation médicalement assistée en Belgique et de ses implications à l'échelle de la société. Notre pays est-il un paradis bioéthique compte tenu de sa régulation en la matière ? Où en est-on au niveau médical et comment les patients vivent-ils ces traitements ? Que devient le corps aux mains de la biomédecine, entre vie et recherche ? Comment interviennent les comités d'éthique ? Que disent le droit et les tribunaux lorsque des affaires comme l'arrêt Perruche sont traitées ? Quels projets animent les parents potentiels ? Quelles visions des rapports entre hommes et femmes découlent des techniques ? La procréation humaine, quand elle se trouve au centre de développements biotechnologiques pointus et rapides, ne touche plus seulement notre intimité personnelle. Elle porte des choix collectifs. Elle est un objet passionnant de recherches interdisciplinaires mais aussi un enjeu politique majeur. Passée sous la loupe de la science politique, de la médecine, du droit, de l'éthique, de l'anthropologie et de la philosophie, elle nous permet de nous positionner, sans a priori idéologique, sur la place de l'expertise scientifique dans notre démocratie. 1. Abstract

Although recent family law debates have been predominantly paedo-centric, the founding of "bio-medically assisted families" still focuses on the individual parents' rights to reproduce. By introducing donations, the donor's genetic contribution becomes instrumental and the legal attribution of parenthood negotiated through expressed intentions. The absence of a genetic, social and legal father can only occur in single women's conceptions by choice, hence calling into question the role of the societal father.This neglects the future child's voice in private and family life issues on at least two levels: informational (lacking information about origins, often related to personal identity) and legal and functional (care provided by both parents). It furthermore emphasises the inconsistency in the treatment of "naturally" and "artificially" conceived children since the latter have restricted access to parental judicial proceedings.The conflicts between individuals in the family go beyond national family laws and become a matter of reconciling progenitors' and children's human rights. Yet the discrepancies between different civil law jurisdictions are remarkable. In addition, the sensitivity of the filiation of children conceived by sperm donation to single women requires more than legal solutions - it requires an interdisciplinary approach encompassing ethics, psychology, anthropology and sociology. Moreover, by arguing and suggesting solutions the issue also becomes political. Hence, this book provokes the curious minds of lawyers, ethicists, physicians, bio-technologists and those assisting and wishing to found families. It clarifies concepts, studies the rationale behind the legal complexity in ten national European jurisdictions, and confronts the rights and responsibilities of the stakeholders, providing a balanced independent conclusion and suggestions towards international harmonisation.

Abstract

Over the past 10 years, a convergence of scientific, demographic, legal and social developments has led to a significant influx of cases of international surrogacy. What was previously a marginal form of parenthood has become a multi-billion dollar industry, raising concerns for surrogate mothers, commissioning parents, and children alike. Lawyers, philosophers and health care professionals have struggled to formulate a framework to ensure the protection of surrogate mothers from exploitation, whilst combatting the vulnerability of commissioning parents to agencies and intermediaries, and providing children born as a result of this practice with certainty regarding their identity, status, and nationality. The transnational nature of the issues raised in relation to international surrogacy agreements means that individual states have struggled to take decisive action, and there remains a myriad of different responses to this issue. This book brings together experts from Eastern and Western backgrounds, to consider the way in which different jurisdictions have responded to surrogacy, both within their own borders, and when an international agreement takes place involving one of their citizens. Each chapter includes a discussion of the laws concerning the establishment and contestation of legal parentage through surrogacy under domestic law; the rules and laws concerning surrogacy arrangements on a domestic level; and approaches to recognition of legal parenthood acquired through surrogacy in other jurisdictions. In addition, the chapters consider the socio-economic context of surrogacy in the chosen jurisdictions, through questions concerning the profile of surrogate mothers and commissioning parents, the involvement of intermediaries, and the nature of the interactions between these parties. In this way, the book provides a comprehensive understanding of the confluences and tensions in the way surrogacy is approached in these jurisdictions, and seeks to identify trends emerging from these different regions. In doing so, Eastern and Western Perspectives on Surrogacy seeks to contribute to the greater understanding of the regulation of surrogacy throughout the world, and will serve as a reference work for anyone involved in practice, academia or law reform in this subject area. Jens M. Scherpe is a Reader in Comparative Law and Director of Cambridge Family Law at the University of Cambridge. He is the Honorary Professor at the University of Aalborg, Cheng Yu Tung Visiting Professor in Law at the University of Hong Kong and an Academic Door Tenant at Queen Elizabeth Building in London. Claire Fenton-Glynn is a Lecturer in Law at the University of Cambridge. She is an Associate Member of Harcourt Chambers in London. Terry Kaan is an Associate Professor of Law at Hong Kong University and Co-Director of the Centre for Medical Ethics and Law.

Abstract

Donor insemination or DI is the oldest and most widely practised form of assisted conception but, until relatively recently, it had been assessed largely from a medical perspective. This 1998 book brings together an international group of social scientists to discuss the social, cultural, political and practical dimensions to DI, relating it to the wider debates about fertility treatment and the place of assisted conception in contemporary society. The contributors consider the experience of DI from the viewpoint of all the various parties involved, including the recipients of the treatment, the sperm providers, the clinicians, the people conceived and policy-makers working in the area. The assumptions informing the practices around DI and the reactions to it are critically examined, with reference to developments worldwide, cross-national issues, the language of DI, gender, sexuality, ethnicity and identity.
